Terms and Conditions

1.  This Offer is open to all American Express Cardmembers whose accounts are billed in Indian Rupees and such accounts being in good standing ("Cardmembers").
2.  This Offer is being made on a 'best effort' basis by Yatra Online Private Limited (“Yatra”) and any participation by Cardmembers in this offer shall be purely voluntary.
3.  Offer means gift of ‘Blackberry Curve’ mobile handsets that shall be given by Yatra to each of the top 5 American Express Cardmembers who would be highest spenders on booking of Travel services on www.yatra.com, as determined by Yatra from their payment history (“Program”) during the period 17th July, 2009 to 30th September, 2009 (“Program Period”).
4.  The winners under the Program shall be decided by Yatra and its decision shall be final and binding in this regard.
5.  The Blackberry Curve handsets will be dispatched by Yatra from its office in Gurgaon, Haryana and the winning Cardmember who accepts the gift shall be liable to bear any incidence of taxes, duties, merchandise dispatch expenses, insurance charges, handling & courier charges or any other incidental charges or expenses or taxes or duties that may be levied upon the winning merchandise or in facilitating the delivery of the prizes to the respective winners.
6.  The Blackberry Curve will be dispatched within 21 days only to the Cardmember, and to no one else representing the Cardmember, or appearing on behalf of the Cardmember can collect the same.
7.  Cardmember needs to contact Yatra call centre for any query/ clarification or confirmation related to the Offer being made to American Express Cardmembers.
8.  Yatra reserves the right to transfer the prize to someone else in case of a dispute with the winner.
9.  Yatra reserves the right at any time without prior notice to add, alter, modify, all or any of these terms and conditions or replace, wholly or in part, this Program by any other Program whether similar to this Program or not or to withdraw it altogether.
10. This Offer/ Program is applicable only for those bookings where the payment has been made by American Express Card (“Card”) only.
11. This Offer is valid only for such bookings where holder of the Card through which payment was made is one of the travelers/guests OR the surname of at least one of the travelers is the same as that of the holder of the card through which payment was made.
12. This Offer is not valid on cancelled tickets or on chargeback transactions. All such cancelled tickets or charge back transactions will not be considered under the Program
13. Yatra shall not be liable for technical or human error during the course of transaction.
14. The Customer agrees that the participation in this Program is good and sufficient consideration to be bound by these Terms and Conditions.
15. All other standard Terms & Conditions mentioned on the Yatra Website (www.yatra.com) would continue to be applicable.
16. The offer is valid on booking of all travel services including All Domestic and International Airlines, Domestic and International Hotel bookings, Train tickets , Bus, Car and other customized holiday packages.
17. Cancellation, rescheduling and refund rules of the airlines, hotels, participating partners and Yatra Online would apply to the bookings / cancellations.
18. This Program can be discontinued at any time at the sole discretion of Yatra and/ or American Express.
19. American Express and/or Yatra is neither responsible nor guarantees the quality of goods or services offered by the participating partners, and is not liable for any defect or deficiency of goods or services so obtained / availed/not availed by the Cardmembers under this program.
20. All disputes arising out of this Offer/ Program shall be subject to the laws of India and the parties hereby unconditionally submit to the jurisdiction of the Delhi Courts.
